Form 21 or a car sale certificate proves that the vehicle’s original owner transferred ownership to another individual and received compensation. As a result, it serves as both an invoice and a receipt for the parties involved in the transaction. The bill of sale can be used by the seller to demonstrate that he sold the car without warranty and that the buyer paid the seller in full in anticipation of acquiring complete ownership of the car.

The bill of sale also serves as a record of the selling price and date of the car. It can be used by both buyers and sellers for tax purposes and to identify when the vehicle’s liability has changed. If an automobile breaches traffic laws or is involved in an accident, the seller can demonstrate that he no longer owns the vehicle and is thus not liable. If the buyer has to insure the car, a bill of sale can be used to verify ownership.

Please note, that in the case of an E-Rickshaw or E-cart, the sale certificate must be issued by a registered manufacturer or dealer, and in the case of a military auctioned vehicle, the sale certificate must be issued by an officer of the Defence Department.

How to fill RTO Form 21?

A car sale certificate is a legally binding document. If you are a buyer, carefully study it and check for contradictions between the terms of sale and what you have agreed upon with the seller.

Pay close attention to the laws and regulations governing payments, guarantees, delivery, and unusual circumstances. Signing the contract means accepting a vehicle with obvious or hidden flaws if the sale certificate clearly says that the vehicle will be sold as-is. It also implies permitting the vendor to refuse to extend warranty coverage. 

The form is divided into 2 sections, section 1 is for the personal information of the buyer, and section 2 is for the details of the sold vehicle. You can fill an RTO Form 21 using the following steps:

  • Begin by filling out the brand name of the vehicle followed by the date and location of delivery.
  • At the time of filling out the form, indicate your name, father’s name, and age in points 1, 2, and 3 of section 1. If you are currently dwelling at a temporary or official address, make a note of it in points 4 and 5, as well as the length of your stay there.
  • In section 2, describe the vehicle’s class in point 1. 
  • From point 2 to point 10, you must write down the maker’s name, chassis number, engine number, and automobile’s technical specifications, such as the body type, vehicle type, brand name, date of manufacture, number of cylinders, horsepower, cubic capacity, wheelbase, chassis number, engine number, seating capacity, fuel, and unladen weight.
  • If you’re registering a transport vehicle, such as a truck or a tempo, you’ll need to provide technical information such as axle type in point 11.
  • In points, 12 to 14, mention the color of the vehicle body, the gross weight, and the type of the vehicle of the body.
  • The form can be completed by adding a signature by the manufacturer or dealer of the vehicle at the bottom right corner.
