RTO Form 28: Application for and Grant of No Objection Certificate (NOC)

When selling a used car, there is a specific method that must be followed to the letter. Filling out and submitting the forms required for a successful transaction is one of the most critical aspects. Form 28 is one of the forms that must be completed. While these forms are available at any RTO, they are also available on the Parivahan Sewa website. Let’s look at the functions of each form when it comes to selling a used car.

To obtain a NOC from the registering authority, you must download and complete Form 28. This form verifies that the car has no outstanding taxes, Challans, criminal histories, or other issues that could prevent you from selling it. To sell a used car, you must fill out three copies of Form 28 and submit them to the RTO.

How to Download RTO Form 28?

A No Objection Certificate (NOC) is an essential document issued by the RTO for the re-registration of a vehicle in a different state. This certificate essentially states that the vehicle has no legal responsibilities and can be sold to another customer. Even if you are permanently transferring to another state, you must re-register your vehicle, which requires a NOC from the previous RTO. This legal certificate informs the new state’s RTO that there are no outstanding challans, tax dues, or FIRs against the vehicle owner and that the old RTO has granted authorization to re-register or transfer ownership of the vehicle.

• Go to https://parivahan.gov.in/
• Click “Informational Services” on the menu tab
• Hover over “Downloadable Forms” in the drop-down menu
• Click “All Form” 
• Click on “Form 28” under the vehicle-related category 

How to fill RTO Form 28?

Form 28 is divided into three sections, just like all other RTO vehicle registration forms. The first component is still concerned with the vehicle’s personal information and statistics, the second section is consent from financiers (whether the car is under a Hire-purchase, Lease, or Hypothecation agreement), and the third section is the NOC’s formal endorsement. A step-by-step guide to completing Form 28 is provided below.

• Mention the RTO address where you want the NOC in the upper left-hand corner of RTO Form 28. Fill in the name of the Registering Authority where you want to transfer your vehicle to the next vacant section.
• In the next box, write the names, addresses, and states of those who want to buy your car. Following that, candidates must fill out their personal information.
• In points 1 and 2, write your name, address, and father’s name. Married ladies can also use this place to mention their spouses’ names.
• Fill in the vehicle’s registration number and class in points 3 and 4. If you are not the vehicle’s original owner, state the name of the Registering Authority who first registered the vehicle.
• In the case of battery-powered vehicles, fill in point 6 with the engine or motor number. Write the chassis number in the next space and attach it with a pencil.
• Mention the length of your stay in the state from which you are requesting the NOC in point 8. In point 9, you must also mention the period for which you paid the motor vehicle tax. If you have any outstanding taxes at the time of form submission, make a note of them in the next box.
• If your vehicle has been engaged in any theft instances, make a note of it in point 11 along with the specifics. At point 12, don’t forget to note any pending actions (if any) under sections 53, 54, or 55 of the Motor Vehicles Act, 1988.
• Commercial vehicles transporting restricted products should have the same information in point 13. Point 14 should be filled with motor vehicles under a Hire-Purchase, Lease, or Hypothecation agreement. In this box, write the Financier’s full name and address.
• Attach your signature or thumb imprint below these details, along with the date the form was submitted.
• Financiers must say whether they agree or disagree with the granting of the NOC under section 48(3) of the Motor Vehicles Act 1988 in the next section. In the event of a denial, the Financier must provide a detailed explanation.
• The final section of Form 28 is the official endorsement, which is where the Registering Authority verifies or rejects the NOC by affixing the representative’s date, signature, and address. He also explains why the NOC has been refused. Finally, the official enters the Registered Owner’s, Financier’s, and Registering Authority’s names in order to submit the document by Registered Post with an acknowledgment due date.
